What’s the Legal Status of Embryos?
February 7, 2005 · By Tom Cerber
Interesting story out of Chicago of a couple suing a fertility clinic for accidently destroying their frozen embryos. They’re not suing the clinic for destruction of property, but for wrongful death. Suing for destruction of property is consistent given the post-Roe v. Wade view of embroyoes, but it’s interesting that the court is willing to consider this as a wrongful death.
